TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Liberty Trailer Rentals, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, YOUR RELIANCE ON ANY COMMUNICATIONS, OR YOUR USE OF ANY RENTED TRAILER.

IN NO EVENT SHALL THE TOTAL LIABILITY OF Liberty Trailer Rentals TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS EXCEED THE TOTAL AMOUNT PAID BY YOU TO Liberty Trailer Rentals IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14) Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Liberty Trailer Rentals services that cannot be resolved informally shall be submitted to binding arbitration administered by a mutually agreed upon arbitration service, conducted in Liberty County, Texas, and governed by the Federal Arbitration Act. The arbitrator's decision shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Liberty Trailer Rentals. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction in Liberty County, Texas.

15) Force Majeure

Liberty Trailer Rentals shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, severe weather events, flooding, fire, government actions, equipment failure, supply chain disruptions, or other events outside Liberty Trailer Rentals's reasonable control. In such events, Liberty Trailer Rentals will make reasonable efforts to notify affected customers and reschedule or resolve the matter as promptly as possible.
